Carry out shoddy investigations?<br /><br />The Court of Session judgment is well worth reading - the list of errors committed by the Comissioner and his staff is astounding. It was acknowledged that the Commissioner's approach lent itself to "manipulation". It quickly became apparent that the tribunal scrutinised many of the cases in much more detail than the Commissioner and his staff did. In Scotland there is no such tribunal and the Commissioner's decision is held to be final - unless you appeal to the Court of Session.
